Abstract
Un fonctionnaire français ne peut, en principe, créer une entreprise. Mais dans un cas très particulier, une loi récente du 12 juillet 1999 autorise le chercheur au statut de fonctionnaire à créer une entreprise pour valoriser ses travaux de recherche. Cette exception met en œuvre un dispositif juridique novateur et complexe qui précise les conditions d’une telle création et lui fournit certains moyens. Notre recherche étudie la façon avec laquelle les acteurs concernés, les chercheurs et leurs établissements appréhendent ce dispositif. L’analyse de plusieurs situations de création nous démontre qu’ils développent une instrumentalisation des textes dans le sens où ils utilisent le dispositif (ou certaines de ses parties) comme un instrument pour atteindre un résultat conforme à certains de leurs intérêts. Or, chercheurs et établissements n’ont pas toujours des intérêts convergents.
