Abstract
Résumé Considérant les nombreux atouts du télétravail à domicile, de plus en plus d’employeurs l’adoptent ou songent à l’implanter pour leurs employés. Cet article vise à répondre aux principales questions que se posent les employeurs qui sont désireux d’instaurer le télétravail à domicile ou qui gèrent des télétravailleurs. Tout d’abord, nous distinguons le travail à domicile du télétravail à domicile. Puis, nous commentons l’accord-cadre sur le télétravail qui a été adopté par l’Union européenne en 2002. Par la suite, nous clarifions les différents aspects juridiques de la gestion du télétravail : le caractère volontaire et réversible du télétravail, les conditions de travail des télétravailleurs (le principe d’égalité, la représentation syndicale, l’organisation du travail et le temps de travail), les informations à communiquer aux télétravailleurs, la prise en charge des coûts et la déductibilité des dépenses liées au télétravail, la santé et la sécurité des télétravailleurs de même que la protection de l’intérêt social de l’entreprise et de la vie privée des télétravailleurs.
