La tempête Xynthia a montré les failles du dispositif juridique encadrant l’urbanisation en bordure du rivage de la mer. Le présent article analyse l’état actuel du dispositif de la loi littoral, pierre angulaire du cadre juridique de maîtrise de l’urbanisation sur les communes littorales, qui n’aborde la question des submersions marines que de manière indirecte. Au-delà de l’analyse du dispositif existant, les auteurs proposent des modifications aux dispositions de la loi littoral afin qu’elle intègre la problématique des submersions marines, et permette in fine une prise en compte effective du risque naturel dans la politique d’aménagement du littoral.
