Abstract
La constitutionnalisation des droits et libertés dans la Charte canadienne des droits et libertés continue de susciter des débats quant à la légitimité du contrôle constitutionnel par les tribunaux. L’auteur analyse la controverse doctrinale sur la justice constitutionnelle en présentant les différentes idées élaborées par les critiques de ce contrôle et les théories qui cherchent à en justifier la légitimité. Selon l’auteur, ce débat demeure marqué par le positivisme juridique, ce qui laisse entrevoir la nécessité de repenser la fonction du juge constitutionnel sur la base de conceptions plus satisfaisantes du jugement juridique, de la séparation des pouvoirs et de la démocratie.
