Abstract
Le législateur français a tenté au cours des quarante dernières années de trouver un équilibre entre les intérêts particuliers et l'intérêt général, porteurs de droits potentiellement opposés: droit à la vie privée face à la liberté d'expression ou face à la transparence démocratique, droit à l'oubli face au droit à la mémoire et à l'histoire. Ce difficile équilibre s'est consolidé progressivement dans un contexte marqué par le traumatisme de la Seconde Guerre mondiale puis par la montée en puissance de nouvelles technologies de l'information.
