Abstract
Comment le télétravail peut-il se mettre en place en droit québécois du travail sans qu’il n’entraîne une violation injustifiée du droit au respect de la vie privée des télétravailleurs à domicile ? Pour tenter de répondre à cette question, les auteurs tracent d’abord un portrait du cadre juridique du droit du travail québécois en ayant en tête son application au télétravail. Ensuite, ils passent en revue la jurisprudence des tribunaux pour voir la portée que ceux-ci ont donnée au droit à la vie privée. Enfin, les auteurs mettent en relief certains arguments justifiant une pondération à la hausse de l’expectative raisonnable de la vie privée du télétravailleur à domicile, le télétravailleur salarié n’ayant pas renoncé à son droit à la vie privée du seul fait de sa subordination juridique à l’employeur. Qui plus est, le télétravailleur à domicile exécute sa prestation de travail depuis le domaine souverain de la vie privée, son domicile.
