Si de nombreuses recherches ont étudié les pratiques de débat et de concertation publics, peu ont traité des effets de ces débats sur les relations entre composantes du « système » elles-mêmes ainsi que des tensions qui les opposent. Or, la concertation publique peut introduire - ou accentuer - dans certaines circonstances - des conflits entre décideurs et servir de recours pour les surmonter. Pour mettre en évidence cet aspect rarement envisagé, on s’appuiera sur le thème des risques industriels/technologiques majeurs. On montrera comment la mise en œuvre des nouveaux Plans de prévention de risques technologiques (PPRT), issus de la loi Bachelot de 2003, crée une situation de tension entre l’État et les collectivités territoriales, en raison de l’opposition entre des discussions tendues vers la protection de l’environnement et des échanges orientés par la défense d’intérêts singuliers. Pour maîtriser ces tensions, les dispositifs de concertation publique sont considérés par les autorités (élus territoriaux et administration d’État) comme un levier dont le contrôle devient un enjeu essentiel. Autrement dit, l’épreuve de légitimation publique se présente, à la fois, comme un perturbateur de la régulation par le pouvoir politique fonctionnel et comme un mode de traitement de cette perturbation. Dans cette optique, l’objectif initial des PPRT se transforme, passant de la réduction des risques à la source à la protection contre les conséquences possibles d’une catastrophe.
