Abstract
La Charte des droits et libertés de la personne du Québec et la Charte canadienne des droits et libertés exercent aujourd’hui un effet structurant sur le droit du travail. Inspirés du droit international, ces textes à valeur constitutionnelle ont des incidences bien concrètes sur l’ensemble des relations de travail, que celles-ci soient individuelles ou collectives ou encore qu’elles mettent en présence un employeur du secteur public ou privé. Ce nouveau phénomène de constitutionnalisation du droit du travail entraîne sur la discipline un triple effet (un effet de modernisation, un effet d’uniformisation et un effet de complexification) qui touche directement toutes les institutions du monde du travail (tels les employeurs, les syndicats, les instances juridictionnelles spécialisées dans le domaine du travail), les appelant ainsi à se redéfinir.
