Abstract
Sur les réseaux numériques, la réussite attestée des œuvres libres conduit à s’interroger sur le modèle de gouvernance mis en place dans les communautés mixtes. Cette gouvernance doit nécessairement s’établir dans le respect de l’éthique du « libre ». Celle-ci impose une relation antinomique pour le donneur de licence diffusant une œuvre comme telle, entre la liberté qu’il doit assurer à la communauté dans sa participation à l’œuvre et la nécessaire gestion des contributions pour maintenir la cohérence de l’œuvre. L’objet de cet article est dans un premier temps de cerner cette éthique du libre établie à partir de normes sociales, puis de concevoir une gouvernance bicéphale en mesure de répondre à cette dualité de contraintes. Cette dernière sera notamment évoquée dans une perspective sociale au travers des facteurs de participation à une communauté et dans une perspective juridique tenant à la polarisation des droits sur la production collective de contenu.
