Abstract
Dans le présent travail, l'auteur s'interroge sur une notion tellement connue que l'on en oublie ce à quoi elle correspond vraiment : le contrat. En effet, la pratique courante, et plus précisément les techniques modernes de communication telles que l'échange de documents informatisé (EDI), nous incite à croire qu'une révision de la théorie générale des contrats devrait être amorcée. Sur la base de l'oeuvre de conceptualisation du professeur américain Ian R. Macneil, l'auteur propose de revisiter ce concept phare, substituant la sacro-sainte volonté à une notion plus adaptée, plus sociale. Son objectif avoué est donc bien de rétablir une meilleure correspondance entre la pratique et la théorie, plus précisément entre la réalité du commerce électronique et la notion de contrat.
