Abstract
Au Québec, au cours du vingtième siècle, la progression de l’autonomie individuelle et la perte d’influence de l’Église catholique, accompagnée de la concurrence religieuse induite par le multiculturalisme, ont profondément transformé le droit de la famille. L’ancienne législation visait à favoriser la conception unitaire de la famille, basée sur le mariage, au nom de l’intérêt supérieur de la société. L’auteur estime qu’il existe désormais un nouveau régime du droit de la famille, dont l’objectif principal est d’assurer la protection, notamment économique, des membres de la cellule familiale. Le corps familial, institution sociétale centrale, dont la conception traditionnelle et religieuse faisait reposer l’autorité absolue sur le mari, n’échappe dorénavant plus à la volonté individuelle et fonde ses grandes lignes sur les valeurs fondamentales que sont l’égalité et l’autonomie individuelle.
