Abstract
Le système juridique canadien repose sur le principe fondamental de la primauté du droit. La notion de primauté du droit est conçue comme un principe constitutionnel exerçant une contrainte effective sur l’action gouvernementale indépendamment de l’existence d’une disposition législative ou constitutionnelle formelle explicite. Son importance figure au premier plan de plusieurs décisions canadiennes, dont le célèbre arrêt Roncarelli c Duplessis, où la Cour suprême du Canada a reconnu qu’un membre du gouvernement pouvait être tenu personnellement responsable de certains actes accomplis dans l’exercice de ses fonctions. C’est donc dans ce contexte que la thématique « égalité de tous sous la loi » trouve toute son importance. Elle exige que toute communauté politique adhérant à l’idéal d’un État de droit s’interroge sur les rôles légitimes respectifs du législateur, du pouvoir exécutif et des instances judiciaires.
