L’application de la Loi sur la transparence et l’éthique en matière de lobbyisme fournit un beau cas de figure aux fins d'une réflexion sur l’éthique en milieu municipal. Cette loi, qui s’applique dans l’ensemble des municipalités du Québec depuis juillet 2005, affirme qu’il est dans l’intérêt du public de savoir qui cherche à influencer des décisions devant être prises dans l’intérêt public. Elle impose en conséquence aux lobbyistes actifs auprès des municipalités des obligations spécifiques de divulgation dans un registre public, de façon à actualiser le nouveau droit à la transparence que cette loi reconnaît aux citoyens relativement aux processus décisionnels d’intérêt public. Alors que plusieurs titulaires de charges publiques ont pu penser que cette loi ne les concerne pas directement, puisqu’elle impose l’obligation de divulgation aux lobbyistes, la nature même de leur charge et les conditions générales de leur responsabilité leur dictent certes, à cet égard, à tout le moins un devoir de diligence raisonnable. En l’absence d’une obligation légale spécifique, ils sont clairement interpellés par l’affirmation législative du droit des citoyens de savoir qui cherche à influencer les processus de décision d’intérêt public dont ils sont responsables ou auxquels ils sont associés.
