Abstract
La nouvelle Loi sur l'instruction publique (loi 107) organise le système scolaire public pré-collégial québécois sur une base linguistique plutôt que confessionnelle, division qui était la sienne depuis sa création. Si la Loi est entrée en vigueur le Ier juillet 1989, l'application de certaines de ses dispositions a cependant été retardée. Le législateur voulait d'abord en vérifier la validité en regard des garanties confessionnelles accordées par l'article 93 de la Loi constitutionnelle de 1867. Ce texte examine certains problèmes constitutionnels posés par la Loi 107 à la lumière de l'état actuel du droit.
