Dans le présent article, l’auteure s’intéresse à certains problèmes soulevés par les moyens permettant de signaler les droits intellectuels aux tiers. Le Canada et les États-Unis tiennent des registres de publicité volontaires pour les marques de commerce et les droits d’auteur, mais des registres obligatoires pour les brevets et les dessins industriels. Par ailleurs, les pratiques de marquage (copyright, tous droits réservés : © ; marque déposée : MD ou ®, etc.) n’y sont que partiellement encadrées. Par contraste, la France ne tient aucun registre de publicité pour les droits d’auteur, mais l’enregistrement des brevets, des dessins et modèles puis des marques y est requis. Le marquage semble ne pas y avoir de portée juridique. Or, le droit de la propriété intellectuelle est complexe et même réputé pour la lourdeur des litiges qui l’animent. L’auteure soutient que la prévention des litiges et le principe de l’effet erga omnes des protections seraient beaucoup mieux servis par un encadrement plus rigoureux des moyens permettant d’informer les tiers.
