Abstract
Le 19 juin 1986 le Parlement a approuvé une nouvelle Loi sur la concurrence qui refonde et amende la loi réglementant la compétition au Canada. Malgré les objectifs louables qui ont présidé à l’élaboration de cette loi, elle comporte des problèmes potentiels dans son application. Ces problèmes, en effet, proviennent du fait que son diagnostic de l’état de la concurrence sur un marché est dérivé, en grande partie, de la vision statique de la concurrence épousée par les économistes au lieu de la vision dynamique de la concurrence des hommes d’affaires. Le point que nous allons élaborer dans cet article est que pour faire un diagnostic exact de la concurrence sur un marché, on doit considérer une mesure de l’innovation des entreprises oeuvrant sur ce marché, lorsqu’on considère « innovation » dans le sens large du terme.
