Depuis vingt ans, la réparation des dommages causés aux automobiles s'effectue suivant le principe de l'indemnisation directe basée sur la faute chaque fois que deux ou plusieurs véhicules sont impliqués dans un accident. Cette innovation majeure présente de nombreux avantages par rapport au système antérieur, mais certains de ses aspects sont encore mal compris par le public. L'auteur relate d'abord les circonstances qui ont amené le législateur à adopter ce système en 1978. Il expose ensuite les modifications apportées par la Loi sur l'assurance automobile aux règles générales du Code civil du Québec relatives au contrat d'assurance pour répondre aux exigences de la mise en oeuvre de l'assurance obligatoire et de l'indemnisation directe. Puis, l'auteur discute les conséquences de l'indemnisation directe en ce qui concerne la disparition, dans la police d'assurance automobile, de l'exclusion relative à la conduite en état d'ébriété et en ce qui a trait à la tarification du risque et à la création en 1989 du Fichier central des sinistres automobiles. Il aborde enfin le problème de l'utilisation de l'âge, du sexe et de l'état civil comme facteur de tarification au regard des dispositions de la Charte des droits et libertés de la personne.
