Depuis 2001, sept provinces canadiennes, le gouvernement fédéral ainsi que les Territoires du Nord-Ouest ont légiféré afin d’instaurer des élections à date fixe tous les quatre ans. Chacune de ces lois préserve toutefois le droit du gouverneur de dissoudre la législature, de sorte qu’une élection générale peut en théorie être déclenchée à tout moment. Dans le texte qui suit, les auteurs examinent le sens à donner à de telles lois et ils les mettent en corrélation avec les dispositions de la Constitution du Canada qui régissent la durée maximale des assemblées élues. Par ailleurs, les débats parlementaires révèlent que plusieurs cas de dissolution inopinée ont été envisagés comme légitimes, en plus de la dissolution qui réagirait à un vote de censure à l’encontre du gouvernement. Ainsi, la dissolution fédérale prématurée survenue en 2008 serait légale selon toute vraisemblance. Et les auteurs concluent que, de toute façon, divers principes juridiques rendent non justiciables les éventuelles violations d’une loi sur les élections à date fixe.
