Depuis ses origines, la politique européenne dans le domaine de l’eau a toujours privilégié la gestion de la qualité, notamment à travers la lutte contre la pollution de l’eau, et ce, au détriment de la gestion quantitative et de la lutte contre la désertification et contre la sécheresse. Même si la directive-cadre dans le domaine de l’eau et la récente communication de la Commission sur la rareté de l’eau et la sécheresse de 2007 abordent la gestion quantitative des ressources hydriques, ces mesures ne constituent que la genèse d’une législation communautaire cohérente et solide concernant la disponibilité en eau. Dans l’étude qui suit, l’auteure analyse l’évolution du partage des compétences entre l’Union européenne et les États membres quant à la gestion de l’eau en partant du traité de Rome jusqu’au traité de Lisbonne. D’autre part, elle explore le dispositif européen en matière de gestion quantitative de l’eau, ce qui lui permet de mettre en évidence l’approche communautaire actuelle qui a pour objet de combattre la raréfaction des ressources hydriques dans un contexte de nouveaux défis liés au changement climatique.
