Aboutissement d’une réforme importante, la Loi portant ratification de l’Accord-cadre relatif à la gestion des terres des premières nations et visant sa prise d’effet soulève la question de savoir dans l’intérêt de qui elle a été conçue. Émane-t-elle de revendications des Premières Nations ou a-t-elle été imposée pour satisfaire les besoins de la majorité canadienne ? La réponse à ces questions conditionnera la légitimité et, sans doute, l’effectivité des mesures adoptées. Au terme de cette étude, il appert qu’il ne s’agit ni d’une réforme imposée d’en haut par un législateur représentant une population unanime, ni d’une réforme réclamée par une base autochtone unie. Ce serait plutôt une entente conclue entre, d’un côté, une minorité de groupes d’Autochtones désireux de s’engager dans l’économie de marché et, de l’autre, des autorités fédérales recherchant le désengagement de l’État et répondant aux désirs des banques en faveur d’un nouveau régime foncier conforme aux exigences de cette économie de marché. Ceci rend difficile la qualification de ces codes fonciers, qui ne se rangent ni dans le droit « local » canadien ni dans le droit « populaire » autochtone.
