Abstract
À la lumière de l’affaire Hissène Habré, cet article illustre les obstacles liés à l’exercice de la compétence universelle en Afrique en faisant ressortir les différentes spécificités contextuelles et substantielles des Chambres africaines extraordinaires. Du point de vue du contexte, il revient sur les points saillants qui ont marqué le long processus de la création des Chambres et aborde la question de savoir si ce «nouveau-né» peut intégrer la catégorie des tribunaux internationalisés. Après une confrontation des différents points de vue sur leur nature et au regard des sept critères traditionnels, l’auteur arrive à la conclusion que les Chambres africaines extraordinaires constituent un tribunal internationalisé, bien qu’elles soient le plus « national » des tribunaux dans cette catégorie. Ce volet contextuel s’achève par une brève analyse de la question de savoir si, en poursuivant Habré devant un tel tribunal, le Sénégal se décharge de l’obligation qui est la sienne en vertu de la Convention contre la torture (Nations Unies 1984). En ce qui concerne les spécificités de substance, l’article examine les domaines de compétence et compare les différents crimes par rapport au cadre juridique existant.
