Abstract
Le débat sur l’obtention rationalisée de résultats bénéfiques pour les collectivités mérite d’être ouvertement posé dans le contexte actuel de crises des dettes privées et publiques, au-delà des logiques de performance. Faisant partie du vocabulaire administratif (notamment celui de la santé) en Suisse, au Canada ou en Belgique, l’économicité entend ainsi dépasser la simple rationalité économique et le seul constat de la rareté en droit public pour promouvoir une meilleure combinaison des coûts et des rendements, non pas du service public, mais des services publics. Dans cette perspective, l’économicité peut être hissée au rang de principe et d’une notion à partir de laquelle s’établissent des raisonnements juridiques. En tant que telle, elle est appréhendée comme un outil au service des politiques publiques, détenant ainsi les clefs pour un renouvellement de l’entreprise anthropomorphiste du droit, et par là, de l’action de l’Etat.
