Abstract
L’article 23 de la Charte canadienne des droits et libertés confère aux parents qualifiés le droit constitutionnel de faire instruire leurs enfants aux niveaux primaire et secondaire dans la langue de la minorité de langue officielle de la province qu’ils habitent. La Cour suprême du Canada a récemment statué à l’encontre de trois pourvois relatifs à l’accès à l’école anglaise au Québec. La Cour devait, entre autres, vérifier si réserver l’accès à l’école anglaise aux seuls ayants droit définis dans la Charte de la langue française ne constituait pas une discrimination illicite à l’endroit des parents de la majorité francophone et donc, contrevenait à leurs droits à l’égalité et si, pour se qualifier, un parent ou un enfant devait avoir reçu en anglais la majeure partie de son enseignement primaire ou secondaire. L’auteur analyse et commente ces décisions et évalue leur impact aux plans québécois et canadien.
