Abstract
Résumé. Le monopole syndical établi par la loi argentine vient d'être remis en cause par un arrêt de la Cour suprême, selon lequel le syndicat désigné comme «le plus représentatif» jouit, par rapport aux autres, de facultés et privilèges excessifs. Cela est contraire au principe «d'organisation libre et démocratique des syndicats» inscrit dans la Constitution du pays et à la doctrine des organes de contrôle de l'OIT. Ainsi, la cour reconnaît le rang constitutionnel de la convention (n° 87) sur la liberté syndicale et rejette une unité syndicale imposée par la loi et non librement décidée par les travailleurs.
