En quoi le positivisme juridique constitue-t-il une philosophie du droit résolument moderne ? Telle est la question que nous nous posons à travers cet article. Le constat que nous proposons ici ne préjuge pas du caractère particulièrement adéquat du positivisme juridique par rapport à notre époque contemporaine, mais plutôt de sa pertinence en lien avec la Modernité, que l’on fera remonter, avec les grands découpages historiques, à 1492. Avec elle, l’Homme se réapproprie le droit qui se veut désormais affranchi de toute théodicée et de toute valeur, hormis celle de l’utilité sociale, considérée comme consubstantielle au droit et qui préfigure l’utilitarisme et le fonctionnalisme. Mais le positivisme juridique rencontre peut-être ici aussi ses limites intrinsèques, marquées par l’atrophie de la dimension explicative au bénéfice de la dimension descriptive. En ce sens, paradoxalement, le positivisme juridique justifie une démarche sociologique sur le droit. Démarche née de la démystification et de la banalisation de l’objet droit, mais qui s’évertue pourtant à en critiquer les fondements.
