Abstract
La gouvernance mondiale ne reproduisant pas les conditions d’organisation des pouvoirs d’un régime démocratique, il importe dès lors de se questionner sur la fonction qu’y joue ou que peut y jouer le droit international. Ce dernier peut-il contribuer concrètement à une éventuelle démocratisation de cette gouvernance globale? Nous examinerons ici cette question à partir de l’exemple de la revendication de la reconnaissance du droit d’accès à l’eau qui, en une vingtaine d’années, est parvenue à s’inscrire dans le système juridique international. Après avoir rappelé les conditions de cette inscription et sa portée à la fois sur le plan international et dans le droit interne des États, nous analyserons les caractéristiques spécifiques du rapport entre droit et politique que ce processus donne à voir, puis nous relèverons les conséquences qui peuvent en être tirées du point de vue du potentiel de démocratisation de la gouvernance mondiale.
