Abstract
Dans l’article qui suit, l’auteur rappelle d’abord l’impératif de la conclusion de traités entre l’État et les nations autochtones. Il explique ensuite comment la politique fédérale, selon laquelle les nations autochtones doivent, si elles veulent négocier avec l’État l’aménagement précis de leurs droits spéciaux sur certains territoires, accepter d’abandonner la totalité ou une partie importante de leurs droits ancestraux en échange de droits établis par traité, devient une pierre d’achoppement pour l’entente. Suivent un exposé des principaux rapports, critiques et tentatives hésitantes pour y remédier puis une analyse des solutions de remplacement somme toute insuffisantes qui ont été retenues à l’occasion de la négociation de certains traités. Enfin, l’auteur présente l’actuelle proposition d’entente de principe avec les Innus de Mamuitun et de Nutashkuan, qui pourrait bien annoncer un déblocage du processus général de négociation des revendications de ce type au Canada en faisant le lit d’une nouvelle génération de traités.
