There is a rapidly growing theoretical, and especially empirical, research literature on patients' capacity to consent to all forms of medical treatment. Clinically the assessment of capacity often tends naturally to involve psychiatrists, either because it is likely to be a mental disability that is inhibiting any given legal capacity and/or because the treatment both for any disability (to restore legal capacity) and for which consent is sought may involve psychiatric interventions. This review describes some recent papers relating to the clinico-legal assessment of the capacity to consent to medical treatment and then describes the growing ethical and legal pressure (especially in the UK) to bring mental health care legislation into line with general medical common law by basing the legal right to coercion of treatment upon the patient having lost the capacity to decide for him/herself. It therefore also examines arguments concerning whether there is any ethical justification for having separate and legally discriminatory legislation for those requiring treatment for a mental, rather than physical, disorder.
