La Cour africaine des droits de l’homme et des peuples (ci-après denommée Cour africaine) est la plus jeune juridiction continentale de protection des droits de l’homme. Elle est aussi celle qui aura l’espérance de vie la plus courte, car, avant même sa naissance, sa mort prochaine est annoncée avec le Protocole de Sharm El Sheik qui prévoit la fusion de la Cour africaine des droits de l’homme avec la Cour de justice de l’Union africaine en une Cour africaine de justice et des droits de l’homme. Installée le 2 juillet 2006, et bien qu’elle soit promise à un avenir très incertain, la Cour africaine des droits de l’homme et des peuples n’en mérite pas moins de faire l’objet d’un investissement scientifique. Elle est en effet le premier organe judiciaire créé à l’échelle du continent africain (qui, en outre, servira de base à la future Cour africaine de justice et des droits de l’homme) et est établie dans le sillage d’une demi-douzaine de cours sous-régionales, ce qui laisse un décor à la fois complexe et original.
