Abstract
Les exemples d’initiatives locales, en vue de limiter l’empreinte de l’activité humaine sur l’environnement, se multiplient. L’article qui suit concerne la Ville de Munich, qui a su tirer avantage de sa situation géographique et de l’engouement à l’égard de l’agriculture biologique pour développer un système d’alimentation en eau potable favorable à l’environnement. Cette ville propose aux agriculteurs situés dans une zone de captage de son eau potable une compensation financière pour la reconversion en agriculture biologique. Pour y arriver, elle s’est appuyée sur le droit communautaire, sur lequel elle a construit un ensemble contractuel. Le contrat type qu’elle soumet aux agriculteurs oblige ces derniers à adhérer à une association d’agriculture biologique. L’agriculteur sous contrat est ainsi lié par un double lien : il doit respecter le contrat conclu avec le distributeur d’eau potable et il doit honorer l’engagement pris avec l’association d’agriculture biologique. L’auteur étudie ci-dessous le contenu de ce double lien de dépendance.
