I refer to them as “components” of exploitation rather than as conditions so as to differentiate them from the three conditions of Kirby's heuristic.Kirby provides little argumentation for his claim that TGS arrangements are coercive on the grounds that LMIC surrogates cannot but choose otherwise. This definition is contentious, and although Kirby cites Wertheimer's (Citation1996) alternative account, according to which coercion depends on the commissioning parents threatening to make the surrogate worse off than she otherwise would have been, he does not address whether this type of coercion occurs in TGS arrangements.
