Alors que sous l’empire du Code civil du Bas-Canada, le droit international privé faisait figure de parent pauvre, le législateur québécois a choisi de le codifier en lui consacrant un livre entier lors de la réforme du Code civil, entré en vigueur le 1er janvier 2004. Plusieurs de ces nouveaux articles sont inspirés de textes d’origine européenne. En se concentrant sur la liberté contractuelle qui permet aux parties de désigner le droit applicable à leur relation, élément essentiel dans les relations commerciales internationales, l’auteur a mis en parallèle les nouvelles règles et leurs sources. Au terme de cet exercice, force est de constater que les dispositions étudiées du Code civil du Québec véhiculent généralement les mêmes principes et comportent souvent des prescriptions comparables à leurs modèles. Cependant, on ne peut parler de copie conforme puisqu’il est possible de relever plusieurs points de divergence voire d’opposition.
