Abstract
L’Union européenne regroupe aujourd’hui environ 500 millions de personnes, ce qui représente une source potentielle d’émission d’eaux usées considérable. Un certain nombre d’obligations existent pour le traitement de ces eaux usées, en particulier depuis l’adoption de la Directive 91/271/CEE du Conseil,du 21 mai 1991, relative au traitement des eaux urbaines résiduaires. Le non-respect des échéances prévues par cette directive a entraîné la condamnation, par la Cour de justice de l’Union européenne, de plusieurs États membres, dont la France. Cette dernière vient de faire l’objet d’une nouvelle assignation qui pourrait déboucher, à terme, sur sa condamnation. Sans doute l’État français doit-il assumer de nos jours la carence passée des collectivités locales dont il porte, en partie, la responsabilité. L’heure n’est cependant plus à la tolérance et le droit français évolue aujourd’hui pour saisir la problématique de l’assainissement de la manière la plus efficace, sur le plan de l’assainissement tant individuel que collectif, en prenant appui à la fois sur les lois de police administrative et sur les rapports de droit privé.
