Abstract
Une part importante du travail des juristes consiste à interpréter les textes de loi. Pour ce faire, une multitude de procédés d’interprétation sont à leur disposition. Selon la Cour suprême du Canada, les chartes commandent une interprétation à la fois « large et libérale » et « contextuelle ». Se pose alors évidemment la question de savoir si le principe de l’interprétation large et libérale et la méthode contextuelle sont en tout temps conciliables. À la lecture de la jurisprudence, ces procédés d’interprétation semblent mener à des résultats tantôt convergents, tantôt divergents. Dans le texte qui suit, l’auteure démontre que le principe de l’interprétation large et libérale et la méthode d’interprétation contextuelle sont en fait deux composantes d’une seule et même approche, soit la méthode téléologique. En ce sens, il est possible de les considérer comme des procédés d’interprétation menant nécessairement à des résultats convergents.
