Abstract
RésuméLa gestation pour autrui recouvre trois situations différentes les unes des autres et souvent confondues : dans le premier cas, la mère de substitution renonce à la naissance à ses droits parentaux sur un bébé qui a été conçu par insémination artificielle avec son ovocyte et le sperme du père d’intention après que ce dernier ait effectué une reconnaissance ante natale. Dans le second cas, une mère seulement gestatrice porte un embryon conçu in vitro par les parents génétiques du bébé à qui elle remettra l’enfant à la naissance. Dans le troisième cas, la mère gestatrice porte un embryon conçu cette fois avec les ovocytes d’une donneuse – anonyme ou pas – et le sperme du père d’intention. Cet article s’attache aux multiples conséquences qui découlent de ces différentes situations du point de vue de la parenté (symbolique, légale, pratique) ainsi qu’aux bricolages effectués. La maternité pour autrui gestationnelle dans laquelle la gestatrice n’est pensée que comme une nourrice du fœtus des parents d’intention s’inscrit très bien dans notre idéologie de parenté actuelle. Quand il y a don d’ovocytes, la situation nous semble en revanche plus difficile à penser car elle comporte des implications à plus long terme.
