La question de la responsabilité des gouvernants et plus particulièrement de celle des chefs d’État a connu au cours des dernières années des développements spectaculaires pouvant être qualifiés de « véritable révolution juridique ». On est passé en effet d’une situation d’impunité générale profitant aux chefs d’État criminels, qu’ils soient en exercice ou retirés des fonctions, à l’affirmation d’une responsabilité internationale de nature pénale pour leurs actes publics. L’évolution de la conviction juridique, l’activité des tribunaux internationaux et les audaces nouvelles des tribunaux nationaux se conjuguent pour traduire une dynamique perçue comme un progrès du droit et conduisant inéluctablement à remettre en cause l’immunité du chef d’État. Cette volonté de juger doit être replacée dans une évolution plus vaste qui affecte les gouvernants et l’État lui-même. Dans ce contexte, la question de la responsabilité des chefs d’État est exemplaire. C’est souvent à ce niveau que s’exerce la véritable responsabilité des crimes les plus odieux, dont l’impunité n’est plus acceptée. Mais c’est aussi à ce niveau que se manifeste le plus visiblement la souveraineté de l’État, base sur laquelle l’ordre juridique international est encore construit pour l’essentiel; la règle de l’immunité du chef d’État visait à en assurer le respect. Entre les deux exigences une contradiction peut apparaître. On peut vouloir la résoudre, comme l’évolution présente semble le rechercher, en supprimant l’obstacle juridique que constitue l’immunité du chef d’État. Mais il ne faut pas cacher alors l’enjeu politique considérable qui s’y trouve contenu.
