Abstract
Le présent article porte sur le développement du phénomène contractuel entre le ministère de l'Environnement et de la Faune du Québec et les pollueurs. Dans la première partie, l'auteure présente les trois pratiques qui ont cours actuellement: les ententes officielles et les ententes officieuses portant immunité contre les poursuites ainsi que les régimes légaux autorisant les autorités publiques à remplacer des règles de droit par des normes particulières élaborées pour un pollueur. Dans la seconde partie du texte, l'auteure examine de façon critique les avantages recherchés et les inconvénients de l'approche contractuelle eu égard aux finalités objectives de la protection de l'environnement et elle propose une réglementation accrue de ces pratiques de gestion administrative des activités polluantes afin d'atténuer les inquiétudes que suscite le développement actuel de ces pratiques.
