Abstract
L'Avant-projet de loi portant sur la réforme du Code civil relativement au droit des obligations propose à l'article 1622 de reconnaître au chèque certifié, au mandat postal ainsi qu'au paiement par carte de crédit et par transfert électronique de fonds le caractère de cours légal de sorte que le créancier ne pourrait s'opposer à un paiement exécuté par ces moyens. L'auteure s'interroge sur la capacité des nouveaux instruments de paiement de remplacer le numéraire comme moyen de paiement final et sur les effets du transfert de la monnaie scripturale. La détermination du moment du paiement effectif est également discutée.
