Abstract
Dans le souci de respecter les prévisions des sujets de droit et d'éviter que l'application générale d'une loi nouvelle ne porte indûment atteinte à leurs intérêts, le droit canadien consacre un principe de maintien des droits acquis. Ce texte examine les sources et fondements historiques, juridiques et philosophiques du principe du maintien des droits acquis, en étudie le statut actuel et en décrit l'application jurisprudentielle en droit public canadien. En faisant ressortir certains éléments de la rhétorique et de la politique jurisprudentielles des droits acquis, l'auteur entend notamment montrer que l'applicabilité des lois nouvelles aux faits pendants ou aux situations en cours n'est pas régie par des règles bien strictes : la faiblesse de la présomption de maintien des droits acquis, conjuguée au fait que le terme « droit acquis » constitue une notion floue, a pour conséquence que la solution des problèmes de droits acquis fait bien souvent appel, de la part des tribunaux, à une appréciation de type politique et suppose, en particulier, une comparaison des coûts individuels et sociaux de l'application générale ou restreinte de la loi nouvelle.
