Abstract
Faisant suite à une sentence arbitrale rendue en vertu du chapitre 11 de l’Accord de libre-échange nord-américain (ALENA), relatif aux investissements, le gouvernement du Canada a formulé une demande en révision judiciaire auprès de la Cour fédérale. Le 13 janvier 2004, celle-ci a entériné la sentence arbitrale et a rejeté par la même occasion, la demande du Canada. Certaines faiblesses dans cette décision peuvent être constatées quant à l’interprétation des articles 1102 et 1110 de l’ALENA et quant à l’évaluation de la sentence arbitrale en fonction de l’ordre public du Canada, alors que le différend relève du droit international. Cette décision ne semble également pas prendre en considération les objectifs des parties à l’ALENA et les exemptions prévues au sein de ce dernier en matière de protection de l’environnement. Dans la mesure où ces distorsions paraissent être causées principalement par l’intrusion du droit national dans un différend se référant au droit international, des solutions de rechange au mécanisme de révision judiciaire sont proposées en vue de pallier les lacunes décelées à l’occasion de l’affaire opposant le gouvernement du Canada à SD Myers.
