Les auteurs proposent une réflexion prospective sur le rôle que pourra être appelé à jouer la personnalité des lois dans la nouvelle gouvernance crie qui verra le jour au terme des négociations menées en application de l’Entente concernant une nouvelle relation entre le gouvernement du Canada et les Cris d’Eeyou Istchee conclue le 10 juillet 2007. Après avoir examiné les institutions qui gouvernent actuellement le territoire traditionnel cri au Québec (Eeyou Istchee) conformément au régime mis en place par la Convention de la Baie-James et du Nord québécois, les auteurs concluent que la gouvernance crie actuelle demeure largement fondée sur la territorialité des lois malgré certaines manifestations limitées de lois personnelles. Ils examinent ensuite les différents facteurs susceptibles de déterminer la place respective de la territorialité et de la personnalité dans la future gouvernance crie. Compte tenu de ces déterminants, les auteurs avancent que, même si d’importants pouvoirs cris devraient être territoriaux, le recours à la personnalité des lois pourra être une caractéristique significative et innovatrice du fonctionnement des nouvelles institutions en raison des facteurs suivants : 1) la configuration démographique d’Eeyou Istchee ; 2) le caractère ethnoculturel de la collectivité politique crie ; 3) le fait que plusieurs des nouvelles compétences susceptibles d’être dévolues au gouvernement cri seront adaptées à une gouvernance non territoriale ; et 4) le role possible de la coutume crie dans l’ordre juridique de la nouvelle entité autonome.
