Résumé L’article constitue un commentaire du jugement rendu dans l’affaire Touzet contre la Caisse primaire d’assurance maladie et la s.a. Renault , qui porte sur un cas de suicide au travail. Ce jugement a conclu que les nouvelles règles d’organisation du travail dans l’entreprise constituaient un risque significatif pour la santé et la sécurité des travailleurs, risque que l’employeur aurait dû connaître. Le commentaire décrit les principales questions de fait et de droit que comporte ce jugement en insistant sur les liens entre interprétation des faits et définition du lien causal. Il met l’accent sur l’interprétation judiciaire en tant qu’activité de travail et souligne les apports de la psychodynamique du travail dans l’interprétation de la preuve retenue par le tribunal.
