Abstract

L’innovation biomédicale remet en question nombre d’acquis théoriques dans le domaine de la responsabilité civile. L’incertitude entourant la nature et l’étendue des risques que certaines de ces innovations posent pour la santé humaine affecte la capacité du droit de la responsabilité à prendre en charge leurs victimes et à sanctionner les comportements qui sont à leur source. Cette réalité force un réexamen du rôle que joue le droit de la responsabilité civile dans la gouvernance de la prestation médicale et pharmaceutique et la protection des victimes des développements biomédicaux. Un discours en émergence encourage la transformation du droit privé afin qu’il puisse mieux contribuer à la prévention de ces risques. L’incapacité du droit de la responsabilité à prendre en charge les victimes du risque biomédical a également provoqué le transfert graduel de leur indemnisation au droit public. Ce texte étudie l’influence des objectifs de précaution et de régulation des risques biomédicaux sur le développement et la transformation des règles de la responsabilité civile. Il aborde ensuite le rôle grandissant que l’État s’accorde dans l’indemnisation des préjudices causés par la réalisation des risques biomédicaux. L’exploration de ces deux tendances révèle l’ampleur de la contribution des développements scientifiques à la transformation du droit.
