Abstract
Une interprétation large de la nature des garanties de la Charte, ajoutée à une approche libérale du concept de standing, a eu pour effet d'élargir la classe des bénéficiaires de la Charte de façon à lui faire englober tant les personnes morales que les personnes physiques, de même que celles qui n 'ont aucun intérêt direct ou actuel dans un litige. En étendant ainsi la portée originale de la Charte au-delà de la protection des droits de la personne humaine, les tribunaux s'arrogent un rôle politique qui ne leur appartient pas dans notre système de démocratie parlementaire.
