Abstract
Le droit forme-t-il un système ? Les juristes, les sociologues et les philosophes du droit répondent généralement à cette question par l’affirmative. Cependant, il est frappant de constater le décalage qui existe entre la théorie du droit et la doctrine juridique, dans l’idée qu’elles se font de cette systématicité. Les philosophes et les sociologues se représentent l’ordre juridique à travers le modèle kelsénien de la pyramide des normes ou, plus récemment, à l’aide de la théorie systémiste de Luhmann. Pour la doctrine, la systématicité du droit se manifeste plutôt par une division en branches, domaines et matières juridiques, soit des catégories juridiques s’insérant dans une taxonomie. Est-il possible de rapprocher ces deux mondes ?
