Abstract
Cet article s’interroge sur la façon dont on peut gouverner les réseaux de communication internationaux qui semblent constituer un espace déterritorialisé échappant au contrôle des États-nations. La gouvernance des réseaux de communication pose la question du rôle des États dans leur développement. Depuis la fin du 19e siècle, ceux-ci ont joué dans les pays industrialisés un rôle majeur dans la mise en place des grandes infrastructures de communication. L’État, jadis planificateur et opérateur des réseaux, devient l’animateur d’un ensemble d’initiatives privées. La gouvernance des réseaux de communication soulève le problème de la régulation des informations qu’ils permettent d’échanger. Comment concilier d’une part la liberté d’expression, d’autre part, la protection des droits d’auteurs, de la vie privée ou des cultures nationales? Pour faire face à ces enjeux, les modes traditionnels de régulation — accords intergouvernementaux, organisations internationales — sont aujourd’hui concurrencés par de nouvelles formes de gouvernance coopératives et communautaires.
