Abstract

Alors que plusieurs de nos sociétés démocratiques s’interrogent à l’heure actuelle sur les moyens de préserver et de renforcer le nécessaire lien de confiance entre l’État et les citoyens, il paraît utile d’examiner le rôle du droit et des tribunaux dans la poursuite de cet objectif. Certes il y va de la confiance des citoyens envers l’État qu’ils bénéficient, tant pour ce qui est des décisions individuelles qui les concernent que pour ce qui est des décisions publiques et collectives de grande envergure, de recours ou de mécanismes aptes à assurer le contrôle de l’Administration lorsqu’elle agit de façon arbitraire ou illégale, bref, lorsqu’il y a mauvaise administration. Cependant, ces mécanismes agissent a posteriori; ils ne participent pas d’un effort de prévention. Il est donc important de développer dans l’avenir un droit administratif qui ne se préoccupe pas seulement de permettre un contrôle de la mauvaise administration a posteriori, mais qui s’intéresse aussi à la promotion d’une bonne administration. À cette fin, on peut penser que le défi de ce droit au cours des prochaines années sera de favoriser et même de développer des mécanismes qui permettent, a priori, d’assurer une meilleure qualité de la décision publique, une meilleure transparence et une plus grande participation du citoyen et des groupes concernés.
