Dans la jurisprudence et la doctrine des dix ou vingt années précédant la réforme du Code civil du Québec , le droit comparé avait connu un certain recul par rapport aux décennies antérieures. Il reprit cependant une place d'honneur dans la réforme. Les dispositions de droit nouveau, en effet, sont souvent inspirées d'un droit étranger. La première part revient au droit français et à d'autres droits civils, mais les systèmes de common law, notamment le droit ontarien, ont joué un rôle non négligeable. Des projets d'uniformisation du droit au Canada et des conventions internationales ont aussi été mis à profit. Toutefois, et curieusement, le droit américain occupe une place presque dérisoire dans les sources du nouveau droit. Le droit comparé a apporté au législateur des outils pour moderniser le droit et l'harmoniser avec les systèmes juridiques du monde occidental, sans perdre de vue la préservation de l'intégrité du droit québécois. Depuis 1994, le droit comparé connaît une destinée fort différente dans l'interprétation du nouveau droit par les tribunaux et les auteurs. Son influence directe sur la jurisprudence est pratiquement nulle, sauf en Cour suprême. La doctrine, de son côté, fait souvent appel à des droits étrangers pour interpréter les nouvelles dispositions du Code civil ; ce phénomène devrait s'accentuer au fur et à mesure que la doctrine produira des textes plus approfondis. Les auteurs ont en ce sens une grande responsabilité, soit celle d'assurer l'ouverture du droit civil québécois aux sources étrangères.
