L’Union européenne a adopté en 2009 des règles ayant pour effet d’interdire l’importation ou la mise sur le marché des produits dérivés du phoque, à l’exception de ceux provenant de la chasse pratiquée par les Inuits ou en vue de la gestion durable des ressources marines ou encore ceux rapportés par les voyageurs. Le Canada et la Norvège ont introduit à l’OMC une procédure de règlement des différends contre ces règles. Selon le rapport de l’Organe d’appel, adopté par l’Organe de règlement des différends, ces règles ne sont pas compatibles avec les principes de base du GATT. Elles entrent cependant dans l’une des exceptions à ces principes, exceptions permettant à un État de prendre des mesures restrictives au commerce, dans le cas présent celle permettant de prendre des mesures nécessaires à la protection de la moralité publique. Ces règles doivent toutefois être amendées parce que, telles que conçues actuellement, elles constituent un moyen de discrimination arbitraire.
