Deux types de mutations de la prison contemporaine sont aujourd’hui mis en avant par les recherches françaises et canadiennes: d’une part, ouverture et complexification des rapports de pouvoir, qui remettraient en question la notion d’institution totale; d’autre part, émergence d’un référentiel mêlant reconnaissance des droits, responsabilisation et examen des besoins sous l’angle de la gestion des risques, qui complexifierait notamment l’analyse foucaldienne de la prison disciplinaire. En Belgique, la première mutation se heurte à la dégradation des conditions de détention; par contre, l’apparition de nouveaux problèmes et l’évolution des processus de désaffiliation semblent changer les rapports que le détenu entretient avec la prison. Quant à la seconde mutation, ses signes restent très marginaux et persiste le contraste entre institution totale et discours sur les droits des détenus.
